1. Acceptance of Terms
Welcome to The Better Work Co. By accessing or using our website and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
VizCreator LLC, a Delaware limited liability company ("we," "us," or "our"), reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
2. Description of Service
The Better Work Co. is a professional platform that connects job seekers with mission-driven organizations, including worker cooperatives, B Corporations, climate companies, and social enterprises. The Service allows individuals to create profiles, browse job listings, and connect with companies. Companies can create profiles, post job listings, and discover potential candidates.
The Service is currently provided free of charge. We reserve the right to introduce paid features, subscriptions, or other monetization in the future. Any such changes will be communicated to users in advance.
3. Account Registration
To use certain features of the Service, you must create an account by providing a valid email address. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Accept all responsibility for activities that occur under your account
- Notify us immediately of any unauthorized use of your account
You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this age requirement.
4. Company Accounts
Companies wishing to post job listings must create a company account and complete our verification process. Company accounts are subject to review and approval at our sole discretion. We reserve the right to reject or revoke company account access for any reason.
By creating a company account, you represent that you have the authority to act on behalf of the company and bind the company to these Terms.
5. Job Listings
Companies posting job listings on the Service must comply with the following requirements:
- Salary Transparency: All job listings must include salary or compensation information. Listings without salary information will not be approved.
- Accuracy: All information in job listings must be accurate and not misleading.
- Legal Compliance: Job listings must comply with all applicable employment laws and regulations, including anti-discrimination laws.
We reserve the right to review, reject, remove, or modify any job listing at our sole discretion, for any reason, including but not limited to violations of these Terms or our community standards.
6. User Content
You retain ownership of content you submit to the Service, including profile information, job listings, and messages ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and create derivative works of your User Content in connection with operating and promoting the Service.
This license includes the right to feature your User Content (such as job listings or company profiles) in promotional materials, social media, and marketing efforts for The Better Work Co.
You represent and warrant that you have all necessary rights to grant this license and that your User Content does not violate any third party's rights or any applicable laws.
7. Messaging and Communication
The Service includes messaging features that allow users and companies to communicate. When using these features, you agree not to:
- Send spam, unsolicited messages, or bulk communications
- Harass, threaten, or intimidate other users
- Send content that is discriminatory, racist, sexist, or otherwise offensive
- Engage in sexual harassment or send inappropriate sexual content
- Impersonate other individuals or entities
- Send content that is illegal or promotes illegal activities
Violations of these messaging guidelines will result in immediate account termination.
8. Prohibited Conduct
You agree not to:
- Use the Service for any illegal purpose or in violation of any applicable laws
- Post false, misleading, or fraudulent content
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with or disrupt the Service or servers connected to the Service
- Use automated means (bots, scrapers, etc.) to access or collect data from the Service without our written permission
- Circumvent any security features or access controls
- Use the Service to collect personal information about other users without their consent
- Engage in any conduct that restricts or inhibits other users from using the Service
9. Platform Role and Disclaimer
The Better Work Co. is a platform that facilitates connections between job seekers and companies. We do not handle job applications directly. When you click to apply for a job, you will be directed to the company's own application process or website.
We are not responsible for:
- The hiring decisions made by companies listed on our platform
- The accuracy of information provided by companies or job seekers
- Any interactions, agreements, or disputes between users and companies
- Workplace conditions, compensation, or treatment after employment
- The content or practices of third-party websites you may be directed to
- Any damages or losses arising from your use of the Service or interactions with other users
You acknowledge that you use the Service and interact with other users at your own risk.
10. Intellectual Property
The Service, including all content, features, functionality, software, designs, graphics, and trademarks, is owned by VizCreator LLC or its licensors and is protected by United States and international intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service except for the limited right to use the Service as described herein.
11. Analytics and Data Collection
We use Vercel Analytics to collect aggregate, anonymized data about how visitors use our website. This includes page views, visitor counts, geographic location (country-level), device type, and browser information. This data helps us improve the Service and is collected in accordance with our Privacy Policy.
12. Termination
We may suspend or terminate your account and access to the Service at any time, for any reason, at our sole discretion, with or without notice. Reasons for termination may include, but are not limited to, violations of these Terms, prohibited conduct, or any behavior we deem harmful to the Service or its users.
You may terminate your account at any time by deleting your account through your account settings. Upon termination, your right to use the Service immediately ceases, and we may delete your User Content.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT ON THE SERVICE, INCLUDING JOB LISTINGS AND USER PROFILES.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VIZCREATOR LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED ONE HUNDRED DOLLARS ($100).
15. Indemnification
You agree to indemnify, defend, and hold harmless VizCreator LLC and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your User Content, your violation of these Terms, or your violation of any rights of another party.
16. Dispute Resolution
Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions.
Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Delaware, or at another location mutually agreed upon by the parties. Judgment on the arbitration award may be entered in any court having jurisdiction.
Class Action Waiver
YOU AGREE THAT ANY ARBITRATION OR PROCEEDING SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
Exceptions
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights.
17. Miscellaneous
- Entire Agreement: These Terms constitute the entire agreement between you and VizCreator LLC regarding the Service and supersede all prior agreements and understandings.
- Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
- Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
- Headings: Section headings are for convenience only and do not affect the interpretation of these Terms.

19. Acceptance
By using The Better Work Co., you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these Terms, you must not use the Service.
